A legal regime of person’s identification with the Church Sui Iuris and the issue of its change

Abstract

In his article A Legal Regime of Person’s Identification with the Church Sui Iuris and the Issue of its Change R. Gorban explains etymological and liturgy legal gist of the rite and the Church Sui Iuris. He expands historic and legal development of these notions, approach of the Church to their interpretation according to Catholic Doctrine. He finds out modern understanding of the rite and the Church Sui Iuris. He gives analysis of the procedure and reasons of a worshiper‘s identification with a particular Church Sui Iuris. The author presents criteria of a worshiper‘s identification with a particular Church Sui Iuris, because they as such explore the questions relating to the worshiper‘s identification with a certain rite, emphasizing aspects of free choice, actions and their interaction with the demands of the Church Legislation. He addresses the issue of possible changes of the rite and the reasons for changes. He finds out the way of how the church procedure of the change of the identification with the Church Sui Iuris and the rite is conducted, as well as the ensuing consequences. He specifies the authorities that give permission in all cases. Every indicated issue and circumstances are introduced with the prospect of their practical use.
